Memberships can be cancelled via written notice and completion of a Membership Cancellation Form. Cancellations are subject to a 30-day notice period for both direct debit and upfront memberships.

This form is for the cancellation of the following memberships:

  • Platinum
  • Aquatics

Membership Terms & Conditions

1. Privacy
a) Your personal information will be used to provide and support your membership, communicate updates relating to our facilities and services, and seek feedback to assist us in improving our programs and customer experience. This may include class cancellations, facility closures, timetable changes, membership correspondence and customer surveys.
b) You may choose to opt out of communications once your membership enrolment is complete. By doing so, you acknowledge that you may not receive important updates, notices or information regarding changes that affect your membership, facilities or services.
c) Some information is required to provide your membership and associated services. If this information is not provided, we may be unable to provide or support your membership.

2. Age Limits

  • Swimming pool
    Children under 13 years of age must be supervised by a responsible adult
  • Spa, Sauna and Steam Room
    16 years and over
  • Aerobics and Aqua aerobics
    13 years and over (15 years and over for any weight resistance classes)
  • Hydrotherapy
    16 years and over (except for approved programs)
  • Memberships for Minors
    Minors (under the age of 18) require proof of age and legal guardian authorisation in
    person to register
  • Gym For Minors
    15 -17 are recommended to have an appraisal program

3. Membership Fees and Charges
a) Monthly direct debit fees are subject to change as per the City of Bayswater Fees and Charges Members will be notified of any approved changes to fees prior to changes being implemented
b) To be eligible for concession pricing, members must provide evidence of any concession cards detailed in section 8 of these Terms and Conditions

4. Direct Debit Memberships – EziDebit
a) Direct Debit Memberships are only available on an Ongoing, No Lock in agreement
b) All direct debit payments for memberships are taken on our behalf by EziDebit. The member agrees to make all payments due and agrees to the associated costs charged by EziDebit
c) Cancelling a payment method or placing a stop on direct debits will still incur the agreed membership fees which are required to be paid until 30 days cancellation notice is received by the facility

5. EziDebit Fees for Direct Debit (Subject to change with notice from EziDebit)
a) $2 20 one-off fee with the first direct debit
b) $14 80 fee for any failed direct debit payment
c) The facility cannot reduce or remove these fees

6. Suspensions
a) Memberships can be suspended Fees apply and suspensions cannot exceed 50% of the total membership term
b) Suspensions and changes to existing suspensions must be requested in writing with a minimum of 24 hours’ notice
c) The suspension fee may be waived at the facility’s discretion with a current and valid medical certificate outlining dates and the reason why the member cannot attend the facility for this period
d) During suspension periods, usage of the facility is not permitted
e) The backdating of suspensions is not permitted

7. Replacement Access Fobs
The first membership fob you are given is complimentary Subsequent membership fobs are $6.00 to replace

8. Change of Details
a) It is the responsibility of the member to advise the facility of any changes in personal details
b) Fees apply for failed debits arising from incorrect information

9. Applicable Discounts
Concessions are provided for the following cards
• A current Pensioner or State Concession Card
• A current Seniors Card – A current Student Card
• A current Health Care Card (Government Issued)
• Companion Card Discounts are provided for DVA
Valid evidence of eligibility must be provided to receive concession rates

10. Membership Access
a) Entry to the facility may be refused without a valid membership pass
b) Access fobs are to be used to gain access to the facility programs and services
c) Unauthorised use of membership access will result in immediate suspension of access and review by facility management
d) Management of the facility may refuse entry or request any person to leave the
premises if the person breaches the Member Code of Conduct or Conditions of Entry
e) All members agree to abide by these Terms and Conditions Failure to do so will result in a first and final warning letter Further indiscretions that contravene the terms and conditions may result in immediate termination of the membership. In these instances, no refunds will be given.

11. Membership Cancellations and Refunds
a) Memberships can be cancelled via written notice and completion of a Membership Cancellation Form
b) Cancellations are subject to a 30-day notice period for both direct debit and upfront memberships
c) Any scheduled payment that falls into this 30-day period will be debited as normal before the membership closes
d) Suspensions and missed payments will delay cancellation
e) Further information may be requested by facility staff upon initial cancellation notification

Cancellations may not be processed until the requested information is provided

12. Permanent Illness or Incapacity
a) In this situation, the membership can be cancelled with the 30-day notice period waived by facility management
b) Evidence must be provided in the form of a current and valid medical certificate and must state that the member has a “Permanent Illness or Incapacity’

13. Conditions of Entry
a) Code of Conduct must be followed at all times
b) A towel must be used in the gym at all times
c) Closed in footwear must be worn in the gym
d) Appropriate clothing must be worn at all times
e) Child Supervision is non-negotiable in line with our Age Policy (Section 2)
f) Moving facility equipment is strictly prohibited
g) Training guidance is only to be provided by City employees within its facilities
h) By choosing to opt out of communications, you acknowledge that you may be unaware of changes affecting your membership, facilities or services. We ask that you treat staff with courtesy and respect when seeking assistance regarding information that may not have been received as a result of your decision to opt out.

14. Damage and Personal Injury
To the extent permitted by law, the Centre excludes any liability to the Customer in contract, tort, statute or in any other way for any injury, damage or loss of any kind whatsoever (including, without limitation, any liability for direct, indirect, special or consequential loss or damage), sustained by the Customer and/or any other person, or for any costs, charges or expenses incurred by the Customer, arising from or in connection with this Membership Agreement and/or the services/products provided by the Centre, and/or any act or omission of the Centre

15. Cooling Off Period
This agreement is subject to a 7-day cooling off period. This allows the member to terminate this agreement during the 7-day period which the commences the day the agreement is entered into, not the start date of the membership The member must provide written notice of termination to the place of purchase within business hours in the 7-day cooling off period to have the membership terminated in the clause

When processing the cooling off period, the fitness service can charge the member:
a) Any administration fee that reflects their administration costs, if specified in the agreement
b) A fee for any services already used as part of the membership i.e. pool admissions
